And nearly everyone finds keeping the weight off is even harder. There’s no doubt about it, the majority of diet and fitness regimes are hardly a bed of roses. And those pills, patches and potions, which are supposed to make it easy, are either dangerous or don’t do what they promise. So how CAN you make this easier? The answer lies in your routines. What you habitually do shapes you - quite literally. If you habitually go without breakfast and stuff your face at 11am with cookies because you’re starving, you’ll end up with one kind of body. If you habitually have a yogurt and fruit on waking and take an apple to eat at 11am (when you’ll still be starving) you end up with another kind. If you habitually walk everywhere your shape is likely to be different than if you jump in the car to go a mile down the road. Routines are just patterns of behaviour. Things we feel comfortable doing once we get used to them. We don’t even have to think about them. They’re easy for us - automatic. The answer to easier weight loss AND KEEPING IT OFF then , is in adopting the right routines and habits so that we don’t even have to think - we just do whatever is good for our shape - automatically. The skill is in moving from one set of routines (the kind that keep you overweight) to another - the kind that will result in weight loss and then weight maintenance for the rest of your life. Ive used practically every form of marketing method from public relations and advertising to internet marketing and direct mail. You name the medium; Ive done it… that includes banner towing planes, hot air balloons and highway billboards. But when youre the owner of a small business and captain of your own ship, money is tight and every minute counts so you need to maximize both time and money to the fullest. So, looking at an area that most people just slough off, I am here to tell you how to Market Your Business During Your Lunch Hour. Ive come up with a few things you can do over the lunch hour to promote your business. Here we go: 1. Never have lunch alone. Network with top execs, current clients, people who can influence others, everyone from the pastor at the church to the head of the Chamber of Commerce. Make a list and keep your lunch calendar full. Lets face it, everyone has to eat lunch and if youre buying most people would eat with anyone! 2. Write one article a week. Everyone has expertise on certain subjects related to their field. Write a 600-1000 word article about a focused topic. First come up with a list of topics you want to write about. Then set a goal to have them completed by a certain date; one a week works for me. If you don’t have time, hire a ghost writer (you still get to put your name on it). Where do you find a ghost writer? Check your local newspaper; chances are there’s a writer who’d like to pick up some extra cash. Can’t work with someone so close to home, go two towns away to that communitys newspaper. Or, check out this online resource at: www.writeittight.com. Then publish the articles on the internet using sites like www.arrivenet.com. Why should you go through all this trouble? Its simple. People search online for the solution to their problem or for someone or something that can solve their problem. Once someone reads your article they are pre-sold on your ability to do the same for them, then they contact you. 3. Create or improve your web site. There’s a ton of business out there online, but if your website looks ancient, then there goes your credibility. So, make sure its up to date, has the new articles you just wrote and that you’ve optimized it so search engines can find you. Worse yet, if you dont have a web site, better spend more than your lunch hour creating one. Theres really nothing more important than creating a web site for your business. Want a top notch site? Speak at your local service clubs noon time meeting. Every service club i.e. Rotary, Kiwanis, Womens Club etc, need a speaker. Even if you talk about your hobby, a charity you support or something outside your area of expertise people are getting to know you. People like to do business with someone they know and can trust. Personally I talk about my hot air balloon flights in Michigan and my exploits around the world. Most people find it very interesting and it allows people to get to know me better. The Bottom Line: Your lunch hour is a terrible thing to waste. Put it to good use and watch your business grow and prosper. One more thing. Smith There has been significant growth in the number of lenders offering secured lending to people with credit problems, including those who have been bankrupt, have County Court Judgments logged against them, and for purposes such as debt consolidation. As consumer credit debt tops an eye-watering 1.2 trillion in the UK, it is no wonder that the major lenders in the UK and some significant players from abroad have been falling over themselves to get a slice of the growing sub-prime cake in the UK. But for the IFA there is need for caution. The evolution of the UK sub-prime market needs to be examined and the implications for those who are active in it examined. From an IFAs perspective, get sub-prime business wrong and the consequences could be serious. Several factors caused a growth in demand for sub-prime mortgages in the mid-1990s. These include: mainstream lenders automating credit-scoring procedures; more people with previous debt repayment problems; more marginal borrowers seeking loans for home-ownership and, in the late 1990s, soaring levels of borrowing for consolidation of debts as interest rates rose. Since the early 1990s, a range of factors has created circumstances in which both the demand for, and the supply of, sub-prime lending has flourished. Following the 1990s recession, more people suffered some episode that had harmed their credit rating whether from house repossession, falling into arrears with housing or utility payments, which were pursued more aggressively by privatised companies, having had a CCJ or being made bankrupt. Reflecting broader labour market changes, more people had flexible contracts or terms of employment and income that was variable or hard to confirm.Mainstream lenders, which had suffered during the housing market recession, reacted by exercising extreme prudence in lending, particularly using mechanised and centralised credit-scoring mechanisms to select only low-risk borrowers. Individualised The UK sub-prime sector started to evolve from the mid-1990s with the entry of specialist lenders. These saw a niche for lenders building on a more individualised approach to underwriting and pricing the risks involved in lending to sub-prime borrowers. Luckily a buoyant property market has covered up any deficiencies in the risk pricing models. House prices have more than doubled in the past decade, so it is not advisable to heap too much praise on the sub-prime lending actuaries. A greater proportion of borrowers in the sub-prime sector are in arrears than those in the mainstream sector, as might be expected, around 10 per cent to 15 per cent in 2004.There is also evidence that sub-prime lenders move towards possession more quickly once arrears start to accumulate, on both first and, especially, second mortgages. Now there is a new raft of specialist sub-prime to sub-prime lenders which are mopping up the heavy adverse clients. Competition would on the face of it seem like good news for sub-prime clients and intermediaries active in this segment. This year there are expected to be six new entrants in the UK sub-prime mortgage market. Deutsche Bank has already entered the fray, Oakwood Financial Services enters later this year, headed by the ubiquitous Michael Bolton, formerly of BM Solutions/HBoS. Others of note, include Mortgages Plc which is backed by Merrill Lynch, and is making real inroads with its innovative products, keen pricing, technology and extensive teams of field sales support. GE Capital, GMAC, BM Solutions, Money Partners, Platform the list goes on. These organisations want serious market share and that means sacrificing margin to get to the top of sourcing system best-buy tables. When lenders compress margins, other things can suffer, such as commission payments. At the near-prime end of sub-prime there is now little difference between rates offered by high street lenders and commissions paid. If there is a sustained price war, and the signs are it is under way, only those with big balance sheets will survive. That could mean the end for a number of small niche players. It is like the corner shop taking on Tesco there will be casualties and collateral damage. A favoured niche sub-prime lender may not be around forever. Clearly sub-prime lenders fill a market gap. They allow entry to owner-occupation for those who are able to repay, but fail high street criteria. They allegedly offer credit repair to borrowers who, if they maintain repayments can re-enter the mainstream market. There is an important qualification to make here. Sub-prime lenders in the main will not proactively credit repair clients. Assumptions It would be nice to assume that a sub-prime client who has diligently suffered the ignominy of higher interest rates would automatically get a rate reduction if he paid his sub-prime mortgage for two years without missing a beat. But that is not how it works. Sub-prime lenders securitise their lending portfolios and that means investors who buy these juicy mortgage-backed bonds expect a decent rate of return. Proactively managing these cleansed clients to a better rate would put them at loggerheads with their investors, so it is the customer who misses out. Brokers and IFAs need to remain vigilant and pro-actively manage their cleansed clients back to prime rates with high street lenders or face the wrath of the FSA which is taking an ever closer look at this market segment. Record levels of consumer debt mean that debt consolidation has become increasingly popular. Consolidating can allegedly provide a fresh start for a client whose borrowing has become unmanageable. Sub-prime borrowers are higher risk overall, and face higher interest rates and charges than mainstream borrowers. They also face higher charges.There is evidence that sub-prime lenders are relatively quick to pursue repossession and impose relatively high charges to borrowers in arrears. Repossessions have doubled in number from last year. A worrying trend, and one which would gain real momentum if property prices headed southward. This can lead to a downward spiral for borrowers, through repeated re-mortgaging from lenders at increasingly higher rates and worse terms due to increasingly poor credit records. This is an area of significant importance to intermediaries and one that could come back and bite the unwary. The FSAs initial review of sub-prime lending is no doubt the first of many more detailed investigations as it begins to understand the complexities of the market. In its initial review the FSA was concerned many firms could not demonstrate that they had gathered sufficient information in certain areas to demonstrate suitability of a sub-prime product. All information gathered for the purpose of assessing suitability needs to be recorded. The FSA has sounded the warning bell, reminding brokers that they need to have regard for all relevant facts about a customer of which they should reasonably be aware when selling a sub-prime mortgage product as well as those facts that a customer has disclosed himself.It also added that firms must determine what is relevant when dealing with each customer, but in particular brokers must understand and document: - the customers credit history, including an awareness of his debt position details; - any existing mortgage arrangements and - income and expenditure information to assess affordability. To demonstrate suitability firms can use a factfind document to show that all requirements have been discussed and considered with the customer. Completing a checklist can demonstrate additional considerations have been reviewed with the customer. Enforcement It is only a matter of time before the FSA starts to enforce its treating customers fairly principles. Those in the sub-prime sector can pay significantly more for borrowing than those in the mainstream sector. While this might initially appear to be unfair in that it is the more financially vulnerable who pay the most, the question is really whether such borrowers pay more than is warranted by the extra risk they present. Money advisers, in particular, express concern that people may be tempted to borrow more than they can really afford. Spiralling levels of consumer debt back this up.There is no doubt the FSA will start to monitor what is being done to proactively credit-repair a sub-prime client. Leave a cleansed client on higher sub-prime rates longer than is necessary at your own peril. The TCF principles are there for all to observe, and the FSA does have teeth. The sub-prime market is set for a period of extended competition and consolidation. Factor in the ever- increasing presence of the FSA and its principle-based management and it is clear that you cannot play at sub-prime lending. Unless a company has critical mass and sub-prime is a significant proportion of the business mix, it should tread carefully because there is no doubt that the FSA will claim scalps. The people in the Mediterranean region are known to have a very active life style. Of course physical activities is essential for good health, but good health is based on food habits as well. In other words, the Mediterranean diet is a healthy diet rich in plant food; especially grains, cereals, vegetables, fruit, nuts, legumes and olives. Milk and milk products such as cheese and yogurt are consumed daily on a low to moderate amount. But butter, high in saturated fat is a total no-no in the Mediterranean diet’s recommended food list. Wine is allowed daily on a moderate basis. Food from animals especially chicken, eggs, and seafood are allowed weekly on the Mediterranean diet. For instance, eggs are consumed four days a week. But red meat, high in saturated fat, is a part of the diet only few times a month. The diet recommends veal and lamb to beef because the fat content is comparatively lower than in beef. The meat is cleaned of visible fat and is often roasted or grilled. Sweets and desserts are also a part of the weekly diet. The most preferred dessert is fruit. In summary, food in the Mediterranean diet provides fibers(from mainly vegetables and fruit), good fat(olive oil), nutrition, vitamins, minerals, proteins, and essential acids, necessary for a human body to stay fit evading heart diseases and cancers. Mow A Better Lawn, The Easy Way

By Denton Lesslie I was schooled, as many of you were, about mowing lawns, that each time you mow the lawn the next time you rotate 90 degrees. If you are extra anal you go for the 45 degree rotation. I was never that anal so I just cut on the 90 and things went well. The people that “schooled me” said that it would make groves in my yard where I ran the mover. And, I believed it. Until I moved into my new house, and I followed suit and started my 90 degree rotation. Well we live on a slope becase of 1. the view and 2. the water drainage problem we had in out previous home (that is another story.) I mowed the lawn three times. Twice up and down and once side to side. It was amazing how much easier going across the slope, than going up and down. I spent the rest of the summer going across the slope. Along with the proper fertilization and watering. I kept the blade on the mover sharp and What a Beautiful Lawn. The kids had a ball barefoot and happy. I am a proponent of push mowers. I think that they mow a better lawn and provide and provide a chance to get the blood flowing in between exercise sessions. Working behind a computer as much as I do, that is much needed. I also feel that they give you more control of the mower than a riding mowers. Not to mention that they are safer. It also really hacks me off to see some one terribly over weight mowing a 1/4 acre lot with a riding mower. That is ridiculous! Anyway off my soap box. After I am done, if there is any “clumps” I take the leaf blower and disapate them into the grass. I hate to say it but the more regularly that you mow the less clumps you will have. Marketing Authorisation: Distinction Between Food Additives and Medicinal Products

By Rosanna Cooper The case HLH Warenvertriebs GmbH and another v Germany (Joined cases C-211/03, C-299/03 and C-316/03 to C-318/03) was decided by the Court of Justice of the European Communities (First Chamber). The applicants, HLH Warenvertriebs GmbH and another, intended to import into Germany and market certain products that were on the market as food supplements in the Netherlands. They planned to market the products also as food supplements. The applicant applied for marketing authorisation to market the products in Germany as food supplements. The applicants requested the German federal ministry for consumer protection, food and agriculture to adopt a general decision concerning marketing authorisations, pursuant to national law. The German Federal Ministry refused and they brought proceedings before the regional administrative court against this refusal. The court dismissed their actions. The main ground on which the proceedings were dismissed was that the products were medicinal products, not foodstuffs. The applicants appealed to the higher administrative court. This court then stayed proceedings and referred the case to the Court of Justice of the European Communities (”European Court”) for a preliminary ruling regarding the interpretation of a number of provisions of Community law, in particular:- Novel foods and novel food ingredients (Parliament and Council Regulation (EC) 258/97); Articles 28 and 30 of the EC Treaty; The Community code relating to medicinal products for human use (Parliament and Council Directive (EC) 2001/83); The general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety (Parliament and Council Regulation (EC) 178/2002);and The approximation of the laws of the member states relating to food supplements (Parliament and Council Directive (EC) 2002/46). The European Court decided: In order to classify a product as a medicinal product or as a foodstuff, all the characteristics of the product had to be taken into account as established in the initial stage of the product i.e. where it was mixed, the method by which it was used and whether with water or with yoghurt. Regulation 178/2002 (No 4 above) constituted an additional set of rules in relation to Council Directive (EC) 2002/46 (No 5 above). It was only the provisions of Community law specific to medicinal products which applied to a product that satisfied equally the conditions for classification as a foodstuff and the conditions for classification as a medicinal product. The competent authorities in member states had to:- use the pharmacological properties of a product to ascertain, in the light of the potential capacities of the product, whether it might, for the purposes of the second subparagraph of art 1(2) of directive 2001/83 (No 3 above), be administered to human beings with a view to making a medical diagnosis or to restoring, correcting or modifying physiological functions in human beings. establish the risk to health of human beings of using this product in the context of the classification of the product as a medicinal product. A product which constituted a medicinal product within the meaning of directive 2001/83 (No 3 above) might be imported into another member state only upon acquisition of a marketing authorisation issued in accordance with the provisions of that directive, even where it was lawfully marketed as a foodstuff in another member state. The concept of ‘upper safe levels’ in art 5(1)(a) of directive 2002/46 (No 5 above) was not of importance for the purposes of drawing a distinction between medicinal products and foodstuffs. In evaluating the risks that foodstuffs or food supplements might constitute for human health by a member state, the member state has to take into account whether there is a nutritional need in the population of that member state. However, the absence of such a nutritional need did not in itself justify, either under art 30 EC (No 1 above) or under art 12 of directive 2002/46, a complete ban on marketing foodstuffs or food supplements lawfully manufactured or placed on the market in another member state. Article 1(2) of regulation 258/97 (No 1 above) should be interpreted to mean that a food or a food ingredient had not been used for human consumption to a significant degree within the Community if, when all the circumstances of the case were taken into account, it was established that that food or food ingredient had not been consumed in a significant quantity by humans in any of the member states before the reference date. A national court could not directly refer questions regarding the classification of products to the European Food Safety Authority (EFSA). If the EFSA delivered an opinion, say, in a case forming the subject-matter of a dispute pending before a national court, this might constitute evidence that the national court could take into consideration in the context of that dispute. By Timothy Moore Disability hearings are fairly informal events. Usually, such hearings are conducted at hearing offices (not a courtroom) where the only people present include the Judge (an ALJ, or administrative law judge), the claimant, the claimant’s representative—if they have chosen to retain one—and medical experts chosen by the Judge. AlJ hearings, as they are commonly known, usually last no more than an hour and sometimes only take 15 minutes. From any standpoint, this is not an extraordinary amount of time. Nevertheless, the time in which it takes to hold a hearing is of paramount importance to the person trying to win their disability benefits. As very many claimants for disability benefits discover, winning a claim can make the difference between having a stable monthly income or living a life of uncertainty as to what will happen next. It can even make the difference between having a home and being homeless. It is not at all uncommon to find, when a case has dragged on for too long, that a claimant is being threatened with eviction from their home or foreclosure on their property. The disability hearing before a judge is typically the single most important event that will occur in the disability process. It is a one hour event that will make or break a case. And for this reason, it should be prepared for properly. Unfortunately, 99% of all claimants will not have the skills or knowledge necessary to properly prepare—AND WIN—a case. Therefore, even though it may not be absolutely necessary to have a representative before the hearing level (for example, at the initial claim and reconsideration levels) it is vital to have representation at the time of the hearing. Here are some things to keep in mind if it looks as though you will have to go to a hearing: 1. go to the hearing. Believe it or not, some people don’t attend their own hearings. Obviously, this is a huge mistake and you should not expect a judge to give you full consideration if you don’t show up at your own hearing. 2. Don’t be late for your ssd or ssi hearing. This is something that most judges have little tolerance for. And the same reasoning applies: if you can’t be on time for your own disability hearing, the judge can only conclude that it is notthat important to you. 3. Be prepared. That is, be sure either you or your disability advocate has gotten and submitted to the judge copies of all your recent medical records. In most cases, you can’t win disability benefits without all the records, especially the most recent records being submitted. Follow these tips and you can maximize your chance of being successful on a disability benefits claims.
